The panel will explore the current law and policy paradigms at play in regards to detaining unlawful combatants (and other terms de jour for those detained in the wars in Afghanistan and Iraq), and whether they can be (or should be) held indefinitely without a trial. If they are tried in a court, what type of court? What rights will they have as defendants? What if there is no substantial evidence? These and other corollary questions will be discussed.

Panelist Include: Shane Kadidal, Senior Staff Attorney at the Center for Constitutional Rights, and Tom Nachbar, a professor at the University of Virginia School of law, will be speaking as well.
