The Third Circuit Court of Appeals will hear arguments over whether individuals targeted and surveilled by the New York Police Department (NYPD) solely on account of their religious affiliation have the right to bring suit for injuries suffered as a result of the discriminatory policy. Our plaintiffs include a decorated Iraq war veteran, current and former Rutgers University students, the parent organization of the Muslim Student Associations of Rutgers University (Newark and New Brunswick campuses), a coalition of New Jersey mosques, and the owners and proprietors of a grade-school for Muslim girls. This disparate group of individuals and organizations share just one characteristic: their Muslim affiliation. That fact alone led the NYPD to target and surveil them without any indicia of criminal suspicion in clear violation of bedrock U.S. constitutional principles.

Baher Azmy, CCR’s Legal Director, will argue on behalf of the eleven Plaintiffs who suffered direct, concrete injuries as a result of the NYPD’s policy of singling out Muslims for suspicionless surveillance based on pernicious stereotypes, that the District Court’s dismissal of the case was improper and that it is the Court’s duty to rigorously review the program’s legality.
