Panel Rejects Claims by Aliens of Unlawful Prolonged Detention

In Turkmen v. Ashcroft, a case filed on behalf of Arab and Muslim non-citizens who were subjected to prolonged and abusive detention in the wake of 9/11, the U.S. Court of Appeals for the Second Circuit has upheld a central claim for dismissal but has left open the possibility for holding the architects of the policy responsible.
