The legal problem cited by the judge when he threw out the indictments against Blackwater guards was obvious to American government lawyers within days of the shooting. “It is regrettable that the prosecutors didn’t have the foresight to be able to deal with this problem before the judge had to deal with it for them,” said Vincent Warren, the executive director of the Center for Constitutional Rights.
