Defense for Children International - Palestine v. Biden was filed in November by the Center for Constitutional Rights and co-counsel Van Der Hout LLP against the President, Secretary of State, and Secretary of Defense on behalf of two Palestinian human rights organizations and eight Palestinians in the U.S. and in Gaza. The case challenges the U.S. government's failure to prevent and complicity in Israel’s unfolding genocide of the Palestinian people and asks the court to order the Biden administration to cease diplomatic and military support and comply with its legal obligations under international and federal law.

Gaza by the Numbers

• The people of Gaza have been facing a land, sea, and air blockade by the state of Israel for the last 17 years.
• As of January 24, 2024, at least 25,700 people have been killed in Gaza since the start of Israel’s unfolding genocide in October. An estimated 63,740 people have been injured, and over 8,000 people are missing.
• At least 94 journalists, mostly Palestinians, have been killed in Gaza since October 7.
• The miscarriage rate in Gaza has increased by over 300 percent since the start of Israel’s genocidal campaign.
• As of January 19, Israeli attacks have destroyed over 60 percent of Gaza’s housing units, or over 360,000 residential units.
• Less than half of the hospitals in Gaza are functioning, and the remaining half are only functioning partially. In addition, 378 educational facilities, 122 ambulances, and at least 3 churches and 161 mosques have been damaged.
• Every hour in Gaza, an estimated 15 people are killed, 35 people are injured, 42 bombs are dropped, and 12 buildings are destroyed. During the first six weeks of the war in Gaza, Israel routinely used 2,000-pound bombs, among their biggest and most destructive bombs.
• 90 percent of the population of Gaza has gone a full day and night without eating. 2.2 million face an imminent risk of famine.
• On December 8, 2023, the same day it vetoed a ceasefire resolution at the UN, the Biden administration circumvented Congress to approve an emergency sale and delivery of $106.5 million of weapons to Israel.
• On December 29, 2023, the Biden administration again bypassed Congress to approve a $147.5 million weapons and equiment sale.
